TGS Baltic successfully represents Enefit in the public procurement dispute worth 12 million euros in Latvia

Following a claim submitted by SIA Enefit, the subsidiary of the Estonian electricity producer Eesti Energia in Latvia, the Procurement Monitoring Bureau precluded VAS Latvijas dzelzceļš from conclusion of the electricity supply agreement with AS Latvenergo worth 12 million euros.

The Procurement Monitoring Bureau recognized that the application on the results of the negotiated procedure of VAS Latvijas dzelzceļš submitted by SIA Enefit was well founded, the violations committed by VAS Latvijas dzelzceļš were substantial and could have had impact on the decision of the results in the negotiated procedure. Namely, VAS Latvijas dzelzceļš failed to ensure transparency of the procurement, unjustifiably restricted competition during the negotiations and in substance failed to carry out any negotiations with suppliers within the meaning of the public procurement regulations.

Accordingly, the Procurement Monitoring Bureau precluded VAS Latvijas dzelzceļš to conclude the agreement with AS Latvenergo and imposed an obligation to eliminate violations found during the repeated negotiations and repeated evaluation of the offers submitted in the negotiated procedure.
